I know its bad to reply to your own post, however I found the solution
after a bit more searching.

http://gcc.gnu.org/onlinedocs/libstdc++/faq/index.html#4_4

At the end of the day it looks like its not meant to do it, I can use
"if(open_file==NULL)" to find out if the file doesn't exist, but I
also had the problem of not being able to open a new file, but by
adding "open_file.clear();" after the "open_file.close();" is the
solution.
