Yes, code segment cannot be written to in protected mode; if you try,
you get a GPF.

But you shouldn't need to: once you load DS with the normal DJGPP data
selector, you should refer to data without the segment override.
Since DJGPP sets up DS and CS to have the same base and the same limit
(precisely for this reason), you can freely access any variable via DS
once it is set.
