And it is. Of course, you, Richard Stallman, and the Regents of the 
University of California can argue as long as you want over the definition
of freedom.

Personally, I don't think it's a -horribly- terrible thing to put:

"This program includes code copyrighted by the Regents of the University
of California." 

in the 'Acknowledgments' section (you -do- have one, right?) of your 
documentation. (BTW, I'm no lawyer either, so I don't know if that quite
fits the bill.)

If you want to be free of this restriction, use rand() or write your own
RNG! UCB has the right to copyright their code however they like, and no
one is forcing you to use this code if you don't like its copyright.
