It's an illegal copy, made public when a few hackers broke in there.

The source isn't officially public yet, and you wouldn't be able to release
anything you made with the illegal source code. This is why id Software
weren't that worried about what happened - it will be pretty obvious if anyone
important uses the code. Or so they say.
