That's not because of the CD-ROM drive.  All the DOS interface is in the 
software driver, usually MSCDEX.  For the driver I use, searching for 
volume label when there is no disk in the drive usually just returns ``No 
more files'' error code, as if there is no label on the disk.  What 
*does* function 4Eh return in your case?  Does it return an error code in 
AX?
